Terms and Conditions

 

1.         Scope

1.1       The present Terms and Conditions (hereunder T&Cs) apply to sales and delivery of goods proposed for sale by Dammastock distribution Sarl (hereunder Dammastock) on the website www.dammastock.store(hereunder Website) to its customers.

1.2       Any internet user or potential Customer can view and read the T&Cs on the Website. As a consequence, any order issued through the Website includes the acceptance by the Customer of the present T&Cs with no restrains and reserves. The Customer is required to accept the present T&Cs prior to be able to issue an order to Dammastock through its Website. Therefore, any person issuing an order through the Website declares having full knowledge and understanding of the present T&Cs.

1.3       Dammastock reserves the right to modify those T&Cs. The T&Cs valid at the time of ordering prevail. 

2.         Order

2.1       The Customer issues a formal request for proposal to Dammastock by filling in all necessary information during ordering process on the Website and by clicking on the “I Confirm my Order” button. Dammastock issues an email to the Customer confirming reception of the Order, listing all order details and attributing an Order Reference. This acts as an Order confirmation and allows shipping of the goods.

 

2.2       The sales contract is executed when Dammastock ships the goods to the Customer or indicated shipping address. In case some or all the goods ordered should not be available, Dammastock reserves the right to not deliver the ordered goods. Dammastock will reimburse the Customer for payments already made without delay. The Customer can follow the order status under «My Account » and the sub-menu “Order History and Details”.    

 

2.3       The Customer is responsible that the information provided during ordering is correct and complete.

 

2.4       The Customer must create an account to be able to order through the Website. The Customer is responsible to keep the information provided during account creation current, at all times.

 

2.5       The Customer will keep the username and password to access his account on the Website confidential and should not reveal them to any third party. The Customer is responsible in case his username and password are used by third parties and the Customer is responsible for all orders that may be issued using his account credentials, even if those orders have not been issued by him.

 

3.         Customer Statutes

 

By issuing an order on the Website, the Customer confirms the following conditions are met:

 

-       the Customer is legally entitled to execute legally binding contracts;

-       the Customer is 18 years old or more.

 

  1. Price and Delivery

 

4.1       The prices indicated at ordering prevail. Those prices do not include VAT of 7.7% which will be added on top of the sales order value.

 

4.2       Shipping costs are calculated for each order and are to be paid by the customer. The shipping costs are indicated on the order page.

 

4.3       Orders are delivered to the delivery address indicated be the Customer at ordering. Transfer of risk to the Customer takes place at delivery. The risk passed on to the customer include liability in case of damages to the goods or its packaging, and damages incurred due to usage, handling or storage of the goods.

 

4.4       The information relative to the delivery timelines at the time of ordering on the Website are indicative only and Dammastock reserves the right to change them at any time, even after order reception and confirmation from Dammastock. In particular, delivery timelines for orders issued on the weekend, during holidays and after 14.00 CET during weekdays cannot be guaranteed.

 

5.         Payment Terms and Transfer of Title

 

5.1       The invoiced amount can be paid prior to shipping (through credit card, bank transfer or through Paypal) or after shipping, on invoice, within 10 days of shipment of the goods.

 

5.2       The goods remain sole property of Dammastock until the invoiced amount for that order has been fully paid, including shipping costs, taxes and payment reminder fees.

 

6.         Guarantee

 

6.1       As per Swiss Code of Obligations, the Customer is responsible to verify the integrity and completeness of the delivered goods as soon as possible, as per common business practice, and notify Dammastock within 7 days of delivery of missing items during delivery or damages to the goods for which Dammastock would be liable.

 

6.2       Dammastock is not liable for defects or omissions the Customer should have been able to identify himself through a proper product inspection, unless Dammastock has assured the customer of the defects or omissions do not exist.  

 

6.3       Should the product be damaged or have a factory defect, Dammastock will fix or replace the product with no delay, after thorough appreciation of the defective good. The Customer bears the cost of returning the defective goods to Dammastock

 

6.4       This Guarantee does not limit Dammastock’s liability for ulterior claims from the Customer as per Swiss Code of Obligations.

 

  1.         Right of Return

 

7.1       The Customer can cancel his order without cause within 14 days of issuing the order. The order cancellation can be done in writing or by sending the goods back to the following address:

7.2       The Customer must use a valid RMA number to return the goods and use the original packaging in original condition. The Customer bears the cost of the return shipment and the responsibility and risk for returning the goods in the same conditions as initially ordered.

 

7.3       In case of return of goods, Dammastock will reimburse the Customer for the value of the goods returned within 30 days, to the condition the goods are returned unused and in their original condition and in original packaging.

 

8.         Data Protection

Dammastock treats personal information shared with Dammastock during the contracting and ordering process confidentially. Dammastock may have to share personal Customer information with third parties to be able to manage the order and shipping.

 

9.         Applicable Law and Forum

9.1       Only Swiss Law applies to these T&Cs and to claims resulting from a contractual relation between Dammastock and the Customer, with exclusion of specific dispositions regarding conflict in Law and the dispositions of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

9.2       The courts of Canton Vaud, Switzerland, are exclusively competent for all claims between Dammastock and its Customer. However, Dammastock reserves the right to pursue action against the Customer in the courts assigned to the Customer’s incorporation.

10.       miscellaneous

Should any of the dispositions in the T&Cs be partially or totally void, the validity of the other dispositions in the present T&Cs remain completely valid.
